These Terms of Use ("Terms") govern your use of goportapotty.com (the "Site"), operated by Sales Magician LLC ("we," "us," "our"), and the phone numbers shown on it. By using the Site or calling a number on it, you agree to these Terms. If you do not agree, please do not use the Site.

1. What we do

Go Porta Potty is a free referral service. We connect callers with independent, third-party portable toilet (porta potty) rental providers. We are not a party to any rental agreement, and we do not deliver, own, service or pick up any equipment. There is no charge to you for our referral service.

2. Providers are independent

Providers in our network are independent businesses, not our employees or agents. Each provider sets its own prices, availability, delivery times, service areas and rental terms, and is solely responsible for its services, equipment, licensing and insurance. Any quote, rental or payment is between you and the provider. We do not guarantee that a provider will be available in your area, any particular price, or any delivery time. We encourage you to confirm pricing, terms and any permits you may need directly with the provider.

3. Call recording and follow-up

Calls to numbers on the Site may be recorded and transcribed for quality, training, billing and fraud prevention. By calling, you consent to this. By calling about a rental, you also agree that the provider you are connected with may contact you at the number you called from about your request.

4. Acceptable use

You agree not to: make prank, fraudulent, harassing or automated (robo) calls; use bots, scrapers or other automated means to access the Site or collect our phone numbers; interfere with the Site or our call system; or use the Site for any unlawful purpose. We may block numbers or traffic that violate these Terms.

5. Site content

Information on the Site (for example unit or dumpster sizes, typical uses, and delivery timing) is general guidance only and may vary by provider and location. The Site's content, design and trademarks belong to us or our licensors. You may not copy or reuse them without our permission.

6. Disclaimers

THE SITE AND OUR REFERRAL SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE MAKE NO WARRANTIES ABOUT ANY PROVIDER OR ITS SERVICES OR EQUIPMENT.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SALES MAGICIAN LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES ARISING FROM A PROVIDER'S SERVICES, EQUIPMENT, ACTS OR OMISSIONS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR OUR REFERRAL SERVICE WILL NOT EXCEED $100.

8. Indemnity

You agree to indemnify and hold us harmless from claims arising from your misuse of the Site or your violation of these Terms.

9. Governing law

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in [COUNTY, STATE].
